DELAWARE MORTGAGE
Whereas, MARY MORTGAGOR, mortgagor, of 123 4TH STREET, City of
DOVER, County of LOLLAPALOOZA, State of DELAWARE, hereinafter
called party of the first part, in and by his or her certain
obligation duly executed, bearing even date herewith, stands bound
unto FIFTH NATIONAL BANK, mortgagee, of 234 5TH STREET, City of
DOVER, County of LOLLAPALOOZA, State of DELAWARE, in the sum of
$123456.78 ( one hundred twenty three thousand four hundred fifty
six & 78/100 dollars) payable 360 MONTHLY INSTALLMENTS OF $950.00,
from the date thereof, together with costs and counsel fees, under
the terms and conditions therein expressed.
Now this mortgage witnesseth, that party of the first part for
and in consideration of the aforesaid debt of $123456.78 ( one
hundred twenty three thousand four hundred fifty six & 78/100
dollars), and for the better securing the payment of the same,
with interest, as aforesaid and costs and counsel fees, does
hereby grant and convey unto party of the second part, FIFTH
NATIONAL BANK, situated in the County of LOLLAPALOZA, State of
Delaware.
And it is hereby expressly provided and agreed that if any
action, suit, matter, or proceeding be brought for the
enforcement of this mortgage or the accompanying bond, and if any
plaintiff or lienholder in such action, suit, or proceeding shall
recover judgment in any sum, such plaintiff or lienholder shall
also recover as reasonable counsel fees 3% of the amount decreed
for principal and interest, which counsel fees shall be entered,
allowed, and paid as a part of the decree or judgment in the
action, suit, or proceeding.
Provided, always, nevertheless, that if any party of the first
part, the heirs, executors, administrators, or assigns of such
party shall and do well truly pay, or cause to be paid, unto
party of the second part, the executors, administrators, or
assigns of such party the aforesaid debt of $123456.78 ( one
hundred twenty three thousand four hundred fifty six & 78/100
dollars) on the day and time hereinbefore mentioned and appointed
for the payment thereof with interest, then and henceforth, as
well this present indenture, and the estate hereby granted, as
the said recited obligation, shall cease, determine, and become
void and of no effect, anything hereinbefore contained to the
contrary thereof in anywise notwithstanding.
